General Conditions “Sant Josep Wines Home Delivery Service”


AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP, SCCL (hereinafter AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP) in compliance with the provisions of art. 10 of Law 34/2002, of July 11, on Information Society Services and electronic commerce, through its website and these General Conditions, allows access by electronic means permanently, easily , direct and free of charge to its own identification information (tax data, address and communications address), as well as to the client’s data.


These General Contracting Clauses (hereinafter “the General Conditions”) govern, together with the Privacy Policy and the Cookies Policy, the access and use of the website accessible through the domain name (hereinafter “the Website”), as well as the contracting of products through it. By accessing to the Website the status of User of the Website (hereinafter “the User”) is attributed to the user, and implies acceptance of all the terms included in these General Conditions. In case of not agreeing with these General Conditions, the User must immediately leave the Website without using it.

  1. User Registration


The use of the services provided by AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP does not imply the need to register the User on the Website. The User should only fill in the form on the store page.


In any case, the User will be required to accept these General Conditions, as well as the Privacy Policy and the Cookies Policy.



  1. Shipping terms


Minimum wine order, according to packaging and brands:

  • Bottled wine: a case of 6 or 12 products, mixed or not. For Laquarta, Llàgrimes de tardor, Plana d’en Fonoll Selecció and L’Estació brands, the minimum order can be a 3 bottle case, assorted or not.
  • Bag in box:
    • A 4 unit case in 3L bag in box
    • A 3 unit case in 5L bag in box


Minimum olive oil order, according to packaging:

  • Bottles: a case of 6 units
  • Cans: a case of 3 units
  • PET 5 L contanier: a case of 3 units
  • PET 2 L container: a case of 6 units


The order must be paid in advance by card or bank transfer. An order will be confirmed and validated when the payment has been made and the information has been received at AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP.


Delivery will take place within 48/72 hours once the payment is recieved for shipments to Spain. In other areas depends on the destination.


On holydays delivery may not be guaranteed within the period indicated in the previous paragraph, due to the high volume of orders in the shipping companies.


After the holiday periods, shipping may take 24 or 48 hours due to the high volume of pending shipments. In Spain, August is understood as a summer vacation period.


The service is only available to private customers.


The purchase of products using the home delivery service is subject to the payment of shipping costs, at the buyer’s expense for shipments outside the Spain. Shipping costs for Spain are included in the product. For the rest of the destinations the shipping costs are detailed separately. The cities of Ceuta and Melilla and the Canary and Balearic Islands will have shipping costs.


The shipping costs will depend on the destination and the number of products purchased according to the budget that will be sent to you before making the purchase.


AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP cannot be held responsible for the delay in the delivery of orders by causes not directly attributable to AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP, accidents or force majeure.


The shipping costs mentioned above include, in addition to transporting the products, their packaging in boxes specially designed to transport bottles, insurance against loss or breakage, as well as VAT.


Orders delivery will be made at the delivery address freely designated by the User, which may be his or a third party’s. AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP will not assume any responsibility when the delivery does not take place because of the inaccuracy of the data provided by the User, or for reasons beyond the control of AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP, such as the absence of the user at the delivery address.


In the absence of the recipient and whenever possible, a note will be left with the information necessary to arrange a new delivery to the recipient’s address or the necessary instructions for the recipient to pick up the product at a certain location. In any case, 7 days after the last delivery attempt the order will be returned to origin and the contract will be terminated.



  1. Delivery options


For shipments to Spain (except the Canary Islands), AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP offers different delivery options. The contracting of these delivery options implies the payment of an additional delivery cost at the time of finalizing the order. The availability of these options depends on the delivery postal code.



  1. Warranty and responsibilities


You can return food products after 14 calendar days if they are purchased through internet. This is the usual term for any product purchased in electronic stores, however, in certain cases the return of a food product will not be possible, for which you must go to article 103 of the General Law of Consumers and Users, specifically, letters c) d) and e) contain the most important exceptions. As well as the Commission’s Guide on the Consumer Directive 2011/83 EU, on which the current General Law of Consumers and Users is based.


Product returns will always be made through transport agencies. This guarantee does not extend to the transportation costs of the return, which will be paid by the User.


The civil liability of AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP for the products supplied is limited to the price of such products. The user waives to claim any responsibility to AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP in any case of dissatisfaction with the products purchased, as well as possible failures, slow access or errors in accessing the web including loss of data, or other information that may exist in the computer or network of the user who accesses


In any case, it is the client’s responsibility to verify that the merchandise has been delivered in perfect condition.



  1. Product selection by the User


All Users may contract the purchase of the products that appear on the website detailing the product and the quantity to be purchased through the form that appears on the store’s page, by email or by WhatsApp.



  1. Processing the order


The purchase process in AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP beggins with the products selection by the User. A proforma invoice will be sent by mail in which the products and their prices will be detailed, as well as the shipping costs, if applicable, and the methods of payment.


Once the email is received, the User may make the payment or modify the proposal, also indicating it by email.


The User must ensure that the products in the proforma invoice are the correct ones, and such verification is their responsibility. In the sales proforma the User will see the total price of the selected products and the shipping costs.


The User must indicate the shipping information, including his full name, ID, telephone and address. The User may include other information necessary for the courier, although AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP cannot guarantee its compliance. You must also indicate if you need an invoice.


If the User wants the billing address to be different from the shipping address, he or she must indicate it to the effect: “My billing address is different from the delivery address”.



  1. Price of the products


The prices of the products are those indicated in the attached description. All prices are indicated in the Euro currency (€) and include Value Added Tax (I.V.A.).


Only discounts related to exclusive promotions for this sales channel will be applied.



  1. Payment method


The payment is done through credit card or a bank transfer to the Caixabank account that appears on the proforma invoice.



  1. Confirmation of receipt of acceptance


Once the purchase process is completed, the User will receive by email the order confirmation and the shipment departure date. Likewise, a permanent link to these contracting conditions will be sent to the email address provided by the User.



  1. Right of withdrawal


The buyer will have in any case a period of fourteen (14) days after receiving the order to exercise their right of withdrawal without having to justify reasons or have any sanction.


In accordance with article 102.d) of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, not being applicable the supply of goods that may deteriorate or expire quickly, so the right of withdrawal cannot be exercised on the bottles that have been opened.


The buyer must express their intention to withdraw within the indicated period and must return the product. The User may send an email to the address including his name and address, as well as the number of his order. You can also contact by phone in order to streamline the process of returning the corresponding amounts.


AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP will reimburse the amounts paid by the User without withholding expenses. However, the cost of returning the product will be paid by the User. The payment will be made by the same method used for the payment of the order.


Once the products on which the withdrawal falls have been received and their correct condition verified, AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP will return the amounts paid to the User within a maximum period of 10 calendar days. Products that do not retain their original packaging may suffer depreciation.



  1. Applicable law and competent jurisdiction


These General Conditions will be governed and interpreted in accordance with Spanish legislation. AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP and the User agree to submit any controversy that may arise from the provision of the products or services object of these General Conditions, to the Courts and Tribunals corresponding to the User’s address.



  1. Nullity and ineffectiveness of the clauses


If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said provision or the part of it that is null or ineffective, subsisting the General Conditions in everything else, having such provision, or the part of it that is affected, for not being set.



  1. Security and Confidentiality


AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP guarantees security and confidentiality in all communications with its clients.


AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP guarantees the protection and confidentiality of personal, domiciliary and any other data provided by our clients in accordance with the provisions of the data protection regulations.


All the data provided by our clients to AGRÍCOLA I SECCIÓ DE CRÈDIT SANT JOSEP will be included in the Cooperative’s treatment systems. In compliance with the provisions of the RGPD 2016/679 (EU), you can exercise your rights of access, rectification, limitation of treatment, deletion, and opposition / revocation, attaching a document proving your identity, directing your request to the postal address C/ Estació, 2, 43785 Bot or via email You may also file a claim with the AEPD.
